Terms of use

The short version

SwimSlate is a private place to keep your swimmer's times. It's in early access and free for now — we expect to charge for it eventually, with notice. Your data is yours — export it whenever, ask us to delete it whenever. What it isn't is an official source: the times, standards and qualifying cuts it shows you are a convenience, and the meet's own paperwork is what counts. The rest of this page is that, said carefully.

Who can open an account

You need to be 18 or older to create an account and agree to these terms. Once you have one, you can invite anyone you like to join it — a second parent, a grandparent, the swimmer themselves — and you're responsible for who you let in. Everyone in an account can see and change everything in it, so invite accordingly.

A sign-in of their own is for swimmers 13 and up. Younger swimmers are tracked perfectly well on a parent's account — that's the normal arrangement, and nothing about the app works less well for it. See Privacy for what a swimmer's record actually holds.

Keep your password to yourself, and tell us if you think someone else has it.

What SwimSlate is not

This is the important part, so it gets its own section rather than a line in a list.

SwimSlate is not an official record of anything. Not of your swimmer's times, not of what standard they achieved, and not of whether they've qualified for a meet. The meet's own results and its published sanction document are the official record. SwimSlate is a convenient second copy that does arithmetic for you.

Specifically:

• Times you import are read out of a document by software, and software misreads things. Review what an import found before you rely on it — the app shows you every row and asks, precisely because of this.
• Qualifying cuts come from the sanction document you uploaded, at the moment you uploaded it. Meets revise their standards, their windows and their entry deadlines. A cut showing green in SwimSlate is not an entry.
• Motivational standards are USA Swimming's, as we understand them, applied using the birthday you entered. Get the birthday wrong and every badge is wrong.
• We don't enter your swimmer in anything, don't talk to your club, your team, USA Swimming, or a meet host, and have no relationship with any of them. SwimSlate isn't affiliated with or endorsed by USA Swimming, any LSC, any school or any meet host.

Check anything that matters against the official source before acting on it. If SwimSlate is wrong about something, tell us and we'll fix it — but a missed entry deadline isn't something we can undo.

Your data stays yours

You keep every right to what you put in. We don't claim ownership of your swimmers' times, and we don't use them for anything except running SwimSlate for you — no rankings, no aggregate published anywhere, no selling. Privacy has the full account of what we store and who can reach it.

You can export every swim to CSV from inside the app, at any time, without asking. If you want the account deleted, write to us from an address on it and we'll remove it.

What you upload has to be yours to upload, or something you're allowed to — a meet's public results, your team's record board, a sanction document. Don't put someone else's private information into SwimSlate.

Using it fairly

The short list of things not to do: don't try to reach another account's data, don't attack or probe the service, don't automate it at a volume a family never would, don't resell access, and don't use it for anything illegal. Don't upload malware, and don't use the import feature as a general-purpose document reader — it's there to read swim results.

If you do any of that we can suspend or close the account, and for anything serious we'll do it without notice.

Free while in early access

SwimSlate costs nothing right now. That's a current state of affairs, not a promise for all time — we expect to introduce paid plans later. When we do, you'll hear about it well in advance, existing accounts won't be switched to paid without an explicit choice, and you can export everything and leave.

We also may change, add or remove features, and the service will sometimes be down — for maintenance, or because something broke. We aim to keep it available and we take backups, but we don't promise any particular uptime, and you shouldn't treat SwimSlate as your only copy of anything you'd be upset to lose. That's what the CSV export is for.

Ending it

You can stop using SwimSlate whenever you like; ask us and the account and everything in it goes. We can suspend or close an account that's abusing the service or putting others at risk. If we ever shut SwimSlate down altogether, we'll give you reasonable notice and a chance to export first.

No warranty

SwimSlate is provided as-is and as-available. We don't warrant that it will be uninterrupted, error-free, or that anything it tells you is accurate or complete — see What SwimSlate is not. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Some places don't allow disclaimers like that, in which case it doesn't apply to you.

Limits on liability

To the fullest extent the law allows: we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost opportunities, or a missed meet, entry or deadline — however it arose, and even if we were told it might.

Where liability can't be excluded, our total liability to you for any claim relating to SwimSlate is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. Since SwimSlate is currently free, that means fifty dollars.

This section survives your account being closed.

Changes to these terms

We'll update this page as SwimSlate changes, and the date at the top will say when. If a change materially affects you, we'll tell account holders rather than leave you to spot it. Carrying on using SwimSlate after a change means you accept it; if you don't, export your data and close the account.

The legal bits, and how to reach us

These terms, together with Privacy, are the whole agreement between you and us about SwimSlate. If a court finds part of it unenforceable, the rest stands. Not enforcing something once doesn't mean we've given it up.

These terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules, and any dispute goes to the state or federal courts sitting there.

SwimSlate is operated from Utah, United States. Anything unclear — including this page — goes to [email protected], and a person answers.
